GENERAL TERMS AND CONDITIONS FOR USE OF CHARGING PLACES FOR ELECTRIC VEHICLES

  1. GENERAL PROVISIONS

 These general conditions and rules for the use of electric vehicle charging points (hereinafter: General Conditions) regulate the relationship between the company Charge&GO d.o.o. Beograd and users of charging points for electric cars. These General Terms and Conditions apply to all users of charging points, registered and unregistered, to whom Charge&GO provides services of fixed-term use of charging points for electric vehicles.

2. DEFINITIONS

 In regard to these General Conditions, the terms used here have the following meanings:

– Service provider means Charge&GO, which provides its users with the services of using electric vehicle charging points, which independently or together with the owner of the charging station and/or charging point, determines the charging service prices that are prominently displayed on the Charge&GO platform for using electric vehicle charging points;

– Charge&GO platform and mobile application mean a digital platform and mobile application intended for charging electric vehicles;

– The service means the specific time use of the place for charging the battery of the electric vehicle that Charge&GO makes available to the User on the Charge&GO platform and mobile application;

– User means a natural person who is at least 18 years old and/or a legal entity, an entrepreneur or any business entity, who are owners and/or users of electric vehicles and to whom Charge&GO provides the service of time use of electric vehicle charging points. Users can be registered and unregistered users.

– Registered user means a person who has registered and opened their user account on the Charge&GO platform and/or mobile application as per these General Terms and Conditions;

– An unregistered user is a natural person who accesses the Charge&GO platform and/or application without registering and opening a user account;

– Postpaid user means legal entities with whom Charge&GO has concluded an Agreement on the use of the Charge&GO pre-regional platform and mobile application with contracted postpaid payment. A postpaid user has the status of a registered user.

– Electric vehicle means an electric vehicle as per the definition of an electric vehicle given in the proposal for a directive of the European Parliament and the Council on the establishment of infrastructure for alternative fuels, as well as as per domestic laws and regulations (or in the final version of the directive);

– Charging place means a parking place with a stationary charger that enables direct charging of an electric vehicle with electricity;

– Charging station means the entity of one or more electric vehicle charging places;

– RFID card means the card delivered to the User that enables them to identify themselves at the charging station and/or charging point;

– The general conditions of use of the Charge&GO platform and mobile application mean the conditions and rules for the use of the Charge&GO platform and mobile application that bind all users, which are available on the Charge&GO website – https://chargego.rs/opsti-uslovi-za -use-of-places-for-charging-electric-vehicles /

– The privacy policy means Charge&GO’s privacy policy as per which Charge&GO processes personal data, all as per the Personal Data Protection Act, which is available on the Charge&GO website – https://chargego.rs/politika -privacy-general-terms/ .

3. USING CHARGING SPACE

The User can use charging places/stations available on the Charge&GO platform and mobile application as a registered or unregistered user. The General Terms of Use of the Charge&GO platform and mobile application apply to all users, registered and unregistered, when using places/stations for charging electric cars.

The use of the Service and the fees for the use of the Service differ depending on whether the User accesses the charging point as a registered or unregistered user.

Registered users form a subscription relationship with the Service Provider through the registration process and have their user account. Registered users can use charging places/stations with an RFID card issued by Charge&GO at the User’s request, or directly through the Charge&GO platform or mobile application;

Unregistered users of the charging point/station can access the desired charger by scanning the QR code on the charger stationed at the charging point, or by entering the ID number of the desired charger on the webpage client.chargego.rs. Before using the Service, the unregistered user enters their email address to which a fiscal invoice will be sent and then from there the website will direct them to the webpage for the payment operator where they should input their payment card information. After the top-up, the payment card is debited for the top-up amount and a fiscal invoice is sent to the email address entered by the User. By using the charging points visible on the Charge&GO platform and mobile application, Users accept these General Terms and Conditions, the General Terms of Use of the Charge&GO platform and mobile application and the Privacy Policy.

From the moment of authentication, i.e. scanning the QR code on the charger or entering the ID number of the charger on the client.chargego.rs web portal, i.e. identification od registered Users in accordance with point 4. of these General Terms and Conditions, the User has a period of 1 minute to start a charging session. This 1 minute is not included in the calculation of the fee for the use of services, and it is free of charge. In the event that the User does not start the charging session within 1 minute, he must perform authentication again (scanning the QR code, entering the ID number of the charger i.e. performing the identification of the registered User).

4. USER IDENTIFICATION

Before starting using the Service, the Registered User performs an identification process. The identification of the registered User is carried out to ensure the application of conditions provided exclusively for registered Users.

Registered Users can be identified via an RFID card or other technical devices or means (such as an online platform or mobile phone application) provided by the Service Provider. The Service User chooses a specific method of identification during registration and can change it later as per the General Terms of Use of the Charge&GO platform and mobile application.

5. THE SERVICE FEES

The User is charged a fee for using the Service according to the current price list displayed on the platform and on the mobile IOS and Android application or according to the prices made available to the User in another way.

The Service fees valid at any time are defined in more detail on the platform for each selected charging point, as well as on the mobile IOS and Android applications. The Service fees may vary at different charging points. The User can find the desired charging point at www.client.chargego.rs/map . Fees for using the charging point may differ depending on whether the User is registered or unregistered, using the one-time payment option. Fees for using the charging point are always displayed before the start of the charging session itself.

The Unregistered User pays the Service fee as per the current price list displayed on the platform for each selected charging point, as well as on the mobile IOS and Android applications.

The Registered User is charged for the provision of the Service on a subscription basis, all as per the General Terms of Use of the Charge&GO platform and mobile application.

In addition to the fee for using the service, the User may be charged an additional fee in the event when electric vehicle remains connected to the charger after the end of the charging session (the so-called IDLE FEE). The IDLE FEE will be free of charge for the first 15 (fifteen) minutes, after the charging session has ended, while after the 15 minutes have expired, a fee of RSD 5,00 will be charged for each minute started, until the User turns off his vehicle from the charger i.e. pulls the charging cable out of his electric vehicle. IDLE FEE will be charged from the user’s payment card, and by accepting these General Terms and Conditions, the User agrees to the IDLE FEE charge in case of leaving the vehicle connected to the charger and after the charging session is completed.

6. RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES REGARDING THE SERVICE PROVISION

The User is obliged to keep their electric vehicle in proper condition, which enables the provision of the Service in an adequate manner and thus prevents the possibility of possible damage, either to the charging point or to the electric vehicle itself, due to faulty equipment and vehicle installations.

The user undertakes to refrain from pressing the emergency button (the so-called “mushroom”) and that the provision of the Service will not be interrupted by pressing the emergency button or the stop button, as this button is intended exclusively for the urgent interruption of charging in case of imminent danger and/or breakdown. The User is obliged to interrupt charging in the same way as they started charging, via the mobile phone application, online platform or RFID card.

When using the charging point, the User is obliged to carefully follow the instructions for using the charging station and/or the charging point. Instructions are prominently displayed at each individual charging point.

The User completely releases the Service Provider from any responsibility and undertakes to fully compensate the Service Provider and all third parties for all damages caused by non-compliance with the provisions of these General Terms and Conditions. The User undertakes to compensate the Service Provider for all eventual costs incurred in connection with the damage caused.

The User completely releases the Service Provider from any responsibility and undertakes to compensate the Service Provider and all third parties in full for all damages caused by damage and/or failure of the charging point that occurred due to non-compliance with the given instructions, carelessness or negligence of the User.

In order to prevent damage, as well as in case of danger of doing the damage or in case of damage that has already occurred, the User and the Service Provider are obliged to undertake all measures to prevent or limit the damage that can reasonably be requested and required of them.

The User undertakes to notify the Service Provider without delay if they notice any irregularity or problem when using the charging station and to follow the instructions clearly displayed at the charging station and/or charging point.

By accepting these General Conditions, the User confirms that they have also been informed that the public enterprise Elektroprivreda Srbije, power transmission grid operator EPS DISTRIBUCIJA d.o.o. Beograd and stock company AD Elektromreža Srbije, are responsible for the stability of the power grid and that they are obliged to deliver a certain quality of electricity, as well as to balance the electric power system. This releases the Service Provider from any responsibility in this regard. In the event of a power grid failure, the company responsible for the electric power system (EPS) must without delay either increase the production of electricity from other sources or reduce consumption. The company responsible for the electric power system (EPS) charging points can automatically issue an order to reduce charging power in the event of a grid failure. Interruption of charging is usually short-lived and it can manifest itself through a change in the charging speed or interruption of charging of the electric vehicle, that is, through the return of energy from the battery of the electric vehicle to the grid in the case of V2G systems.

The Service Provider is released from responsibility for any potential grid failure, voltage failure and Internet failure, including errors during the electric vehicle charging service caused by the User’s non-compliance with the instructions for use, the provisions of these General Terms and Conditions, malfunctioning of the RFID charging card or other technical means of identification due to physical damage or other damages caused by matters related to the use or functionality of the charging service.

7. AVAILABILITY OF CHARGING PLACES

The User can see available charging points in real time on the Charge&GO platform and the mobile application as per the colour chart of the designated places (green colour: free charging place; red colour: charging place occupied; green-red colour: the charging station with multiple charging points available, one charging point is occupied and the other is available; grey colour: charging point is unavailable).

The Service Provider and/or the owner of the charging station/place can temporarily or permanently suspend the availability of a certain charging station/place for electric cars due to maintenance, repair or any other circumstances that affect the availability of that charging station/place to the User. In that case, the relevant station must be adequately marked on the online platform and/or mobile phone application.

The User undertakes to leave the place for charging electric cars after the service has been performed in order to ensure the availability of the place for the next user.

8. TERMINATION OF SERVICE

The Service Provider is authorized to temporarily interrupt the availability of the service at certain charging points during the required maintenance and upgrade of the Service. Furthermore, the Service may be interrupted in order to ensure the management of the power distribution grid, balancing the power distribution grid, boosting the quality of the electric power supply and other derived cases. Unavailable charging points will be displayed in real time on the online platform and mobile application in the manner explained in these General Terms and Conditions.

The Service Provider has the right to refuse to provide the Service and to stop providing the Service to the User without delay, if this is required by official regulations or court orders and/or if there is suspected abuse of the User’s account upon receipt of notification by the User about potential abuse, if the Service is used contrary to the terms and rules from these General Terms and Conditions and the concluded Agreement between the Service Provider and the User or if the User otherwise acts illegally or inadequately in relation to the purpose of concluding the Agreement and these Terms. The Service Provider has the right to temporarily limit or suspend the provision of Services in the event that the User has not settled their obligations towards the Service Provider.

 In the event that the provision of the Service is interrupted due to circumstances caused by the User, such as failure to comply with the instructions for using the Service, the User will not be exempt from paying for the Service until the moment of interruption or other obligations they may have towards the Service Provider.

9. TRANSITIONAL AND FINAL PROVISIONS

The Service Provider can change the provisions of these General Terms and Conditions, the prices of the services and their content at any time.

The Service Provider undertakes to inform the User about all the changes made, by publishing the notification on the online platform or mobile phone application.

In the event that the User continues to use the Services after the notification of the changes being made, it is considered that they accept these changes.

If any provision of these General Terms and Conditions is found to be inappropriate or invalid, this will not affect the validity and application of other provisions.

The relations between the User and the Service Provider are regulated by the positive regulations of the Republic of Serbia. The relevant court in Belgrade is responsible for handling all mutual disputes that cannot be previously resolved by mutual agreement.

These General Terms and Conditions are an integral part of all Agreements concluded by the Service Provider with Users regarding the use of charging points, the regional Charge&GO platform and the mobile application. The User confirms by accepting that they have read and fully understood them and that they fully accept them as such.

These General Terms and Conditions enter into force on June 26th, 2024.
